Judge denies motion to suppress in artifacts case

Salt Lake City, Utah (AP) April 2010

A judge has denied a Blanding man’s request to suppress statements he made to a federal agent following a large-scale sting operation targeting illegal trafficking of American Indian artifacts.

David Lacy had asked U.S. District Judge Ted Stewart to suppress information he supplied in an interview because he said he wasn’t informed of his constitutional rights before questioning.

In a ruling, though, Stewart said Lacy was given a proper Miranda rights warning before he waived those rights and voluntarily gave a statement to law enforcement officials.

Lacy is one of 26 people charged after a two-year federal investigation into those that illegally dig, sell and collect artifacts taken from public or tribal lands.
