N.D. Supreme Court says man owes $94,000 in premiums 6-12-07

BISMARCK, N.D. (AP) - A Three Affiliated Tribes business owner owes the state $94,000 in workers compensation premiums, the state Supreme Court has ruled.

The decision affirmed a lower court ruling that Frank Whitecalfe is not exempt from the workers comp program because he lives on the Fort Berthold Indian Reservation.

Tribal sovereignty does not apply because the JFK Raingutters company, which is registered with the secretary of state's office, is not owned by the tribe, justices said.

The unpaid workers comp premiums are from 1999 to 2002. State officials said Whitecalfe had 16 employees at his business, while Whitecalfe said they were independent contractors.
